Welcome to Patché Skin. These Terms of Service (“Terms”) govern your access to and use of the Patché Skin website, online store, products, content, and related services (collectively, the “Services”).

Patché Skin is an independently operated online skincare store. References to “Patché Skin,” “we,” “us,” and “our” mean the operator of the Patché Skin online store.

By accessing our website or placing an order, you agree to these Terms. If you do not agree, please do not use the Services.

1. Eligibility

You must have the legal capacity to enter into a binding agreement to purchase from Patché Skin. If you are under the age of legal majority where you live, you may use the Services only with the involvement and consent of a parent or legal guardian.

You agree to provide accurate, complete, and current information when placing an order or creating an account.

2. Online-Only Store

Patché Skin operates exclusively online and does not maintain a physical retail location that is open to customers.

Any address that may be provided separately for legal or administrative purposes is not a retail location, customer-service location, or product-return address. Customers must not send products to Patché Skin without first receiving written return instructions from us.

3. Products and Product Information

Patché Skin offers skincare, beauty, cosmetic, and related products. Some products may be stored, packed, and shipped directly by third-party suppliers or fulfillment partners.

We make reasonable efforts to present product descriptions, ingredients, sizes, colors, packaging, availability, and images accurately. Nevertheless:

• Product colors may appear differently depending on your screen or device.

• Packaging, labeling, or ingredients may be updated by the manufacturer.

• Product images may contain decorative items that are not included.

• Availability may change without notice.

• Minor differences between website images and delivered products may occur.

Always review the label, ingredient list, warnings, expiration information, and instructions included with the product before use. If the information on the product packaging differs from information shown online, follow the packaging and contact us at support@patchéskin.com.

We may change, limit, or discontinue products at any time, subject to applicable law.

4. Skincare and Medical Disclaimer

Patché Skin products and website content are offered for cosmetic and general informational purposes only. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Nothing on our website constitutes medical or dermatological advice.

Results vary between individuals. Product descriptions, photographs, testimonials, and customer reviews do not guarantee any specific outcome.

Before using a product, you should:

• Read the complete ingredient list and instructions;

• Perform an appropriate patch test;

• Avoid using a product if you are allergic or sensitive to any ingredient; and

• Stop using the product if irritation, discomfort, or an adverse reaction occurs.

Consult a qualified healthcare professional before using a product if you have a medical condition, highly sensitive skin, known allergies, are pregnant or nursing, take medication, or have concerns about whether the product is appropriate for you.

For a medical emergency, contact your local emergency services immediately.

5. Orders and Acceptance

Submitting an order is an offer to purchase the selected products. Receipt of an automated order confirmation does not necessarily mean that we have accepted the order.

We may accept, reject, limit, or cancel an order for legitimate reasons, including:

• Product unavailability;

• Incorrect product or pricing information;

• Suspected fraud or unauthorized payment;

• Incomplete or inaccurate customer information;

• Delivery restrictions;

• Suspected unauthorized resale;

• Violation of these Terms; or

• Circumstances outside our reasonable control.

If we cancel an order after payment has been collected, we will refund the canceled amount to the original payment method, subject to processing times imposed by the payment provider.

6. Prices and Payment

Prices are displayed in the currency shown at checkout. Delivery charges, taxes, customs fees, and other applicable costs will be displayed or described before the order is submitted when reasonably possible or legally required.

You authorize Patché Skin and its payment providers to charge your selected payment method for the total shown at checkout. You represent that you are authorized to use the selected payment method.

We may correct pricing, inventory, or product-description errors. If an error affects an order you have already placed, we may contact you for instructions or cancel and refund the affected order as permitted by law.

Discount codes and promotions:

• Are subject to their stated conditions;

• May expire or be withdrawn;

• May not be combined unless expressly permitted;

• Have no cash value unless required by law; and

• May be canceled in cases of error, fraud, or misuse.

7. Order Cancellation

Customers may request cancellation only before the order has been fulfilled.

An order is considered fulfilled once it has entered processing for shipment, been packed, been assigned to a fulfillment partner, or been shipped. Because fulfillment may begin shortly after an order is placed, we cannot guarantee that a cancellation request will be received or approved in time.

To request cancellation, email support@patchéskin.com immediately with:

• Your full name;

• Your order number; and

• A clear request to cancel the order.

A cancellation is not confirmed until Patché Skin sends written confirmation that the order was successfully canceled.

Once an order has been fulfilled, it cannot be canceled. The customer may instead request a return or replacement under Section 10, subject to eligibility and applicable law.

Nothing in this section limits any cancellation right that cannot legally be waived.

8. Shipping and Delivery

Products may be shipped directly by third-party suppliers or fulfillment partners. An order may arrive in more than one package, and packages from the same order may arrive on different dates.

Shipping times shown on the website or at checkout are estimates unless expressly stated otherwise. Delivery may be affected by:

• Carrier delays;

• Customs processing;

• Weather or transportation disruptions;

• Local delivery conditions;

• High order volumes;

• Supplier processing times;

• Incorrect or incomplete delivery information; or

• Events outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. Contact us immediately if you notice an error. We cannot guarantee that an address can be changed after fulfillment begins.

Patché Skin is not responsible for delays caused solely by circumstances outside our reasonable control, but we will provide reasonable assistance when a shipment is delayed, lost, or misdirected. This does not limit any responsibility imposed on us by applicable law.

9. Customs, Duties, and International Orders

Products may be shipped from a country different from the customer’s delivery country.

Unless checkout expressly states otherwise, the customer may be responsible for customs duties, import taxes, brokerage charges, or other fees imposed by local authorities. Customs procedures may delay delivery.

Customers are responsible for ensuring that ordered products may legally be imported into and used in their destination country. We may cancel an order if shipping or import restrictions prevent lawful delivery.

10. Returns, Replacements, and Refunds

Customers must contact Patché Skin at support@patchéskin.com within 48 hours of receiving the product to request a return, replacement, or refund.

The request should include:

• The customer’s full name;

• The order number;

• The name of the affected product;

• A clear description of the issue; and

• Photographs or video reasonably showing any damage, defect, leakage, incorrect item, or other reported problem.

Requests submitted after the 48-hour notification period may be declined unless applicable law requires otherwise.

Eligible issues

A return, replacement, or refund may be considered when:

• The product arrived damaged or leaking;

• The product is defective;

• The wrong product was delivered;

• A product is missing from the order;

• The product is materially different from its description; or

• A return is otherwise required under applicable consumer law.

We may offer a replacement, refund, partial refund, or another reasonable remedy depending on the circumstances and applicable law.

Change-of-mind and hygiene restrictions

Due to the personal and hygienic nature of skincare and cosmetic products, opened, used, unsealed, tested, or tampered-with products are generally not eligible for a change-of-mind return, except where required by law.

Products must be unused and in their original packaging to qualify for an approved discretionary return.

Return authorization

Do not return a product unless Patché Skin has approved the return in writing and provided return instructions.

Approved returns may be directed to a supplier, fulfillment partner, or designated returns facility. The return destination may differ from the address shown on the original package.

Products must not be returned to Patché Skin’s legal, administrative, or correspondence address. No customer returns are accepted at that address.

Products sent:

• Without prior written authorization;

• To the address printed on the original shipment without our instructions; or

• To any address other than the designated return address

may not be received, identified, or processed.

Return shipping costs

Responsibility for return shipping costs will depend on the reason for the return, our written instructions, and applicable law.

Where a product is confirmed to be defective, damaged, incorrect, or otherwise nonconforming, Patché Skin will provide the remedy and bear the costs required by applicable law.

Refund timing

Approved refunds will normally be issued to the original payment method. Processing times may vary depending on the payment provider or financial institution.

Original shipping fees and customs charges may be non-refundable unless the return results from our error or applicable law requires reimbursement.

The 48-hour notification procedure does not exclude or restrict any mandatory right or remedy available under applicable consumer-protection law.

11. Lost, Stolen, or Undelivered Packages

If tracking indicates that a package was delivered but you cannot locate it, contact us promptly at support@patchéskin.com.

We may ask you to:

• Confirm the delivery address;

• Check with household members, neighbors, or building staff;

• Contact the carrier; or

• Complete a carrier claim or written declaration.

We will review the available tracking and delivery information. Any replacement or refund will depend on the circumstances, carrier findings, and applicable law.

Patché Skin is not responsible for loss caused by an incorrect address supplied by the customer or for theft occurring after confirmed delivery, except where applicable law provides otherwise.

12. Accounts and Customer Information

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

Notify us promptly if you suspect unauthorized access. We may suspend an account where reasonably necessary to address fraud, misuse, or a security risk.

13. Acceptable Use

You may not use the Services to:

• Violate applicable law;

• Commit fraud or submit false information;

• Interfere with the operation or security of the website;

• Introduce malware or harmful code;

• Attempt unauthorized access to an account or system;

• Scrape or collect website data through unauthorized automated methods;

• Impersonate another person;

• Circumvent purchasing limits or security measures;

• Infringe intellectual-property or privacy rights; or

• Use Patché Skin’s content or branding for unauthorized commercial purposes.

We may restrict or terminate access where these Terms are materially or repeatedly violated.

14. Intellectual Property

The Patché Skin name, branding, logos, photographs, graphics, product descriptions, website design, videos, text, and other original content are owned by or licensed to Patché Skin and are protected by applicable intellectual-property laws.

You receive a limited, personal, non-exclusive, revocable right to access the Services for lawful personal use. No ownership rights are transferred to you.

You may not reproduce, distribute, modify, publish, sell, or commercially exploit our content or branding without prior written permission, except where applicable law expressly permits it.

15. Reviews and Other Customer Content

If you submit a review, photograph, testimonial, comment, or other material (“Customer Content”), you retain any rights you hold in that content.

You grant Patché Skin a worldwide, non-exclusive, royalty-free license to host, reproduce, adapt, publish, translate, distribute, and display the Customer Content for purposes connected with operating and promoting Patché Skin.

You confirm that:

• You created the content or have permission to submit it;

• It reflects your honest experience;

• It does not violate another person’s rights;

• It is not fraudulent, unlawful, defamatory, or abusive; and

• You have disclosed any payment, free product, discount, or other material connection.

We may remove content that violates these Terms. We will not penalize a customer merely for submitting an honest negative review.

16. Third-Party Services

Our Services may rely on third-party payment processors, suppliers, fulfillment partners, carriers, analytics providers, or website platforms.

Those services may be governed by separate terms and privacy policies. Although third parties may help fulfill an order, your purchase contract remains with Patché Skin unless checkout clearly states otherwise.

17. Privacy

Our collection and use of personal information are described in our Privacy Policy and, where applicable, Cookie Policy.

By placing an order, you acknowledge that information necessary to process and deliver the order may be shared with payment providers, suppliers, fulfillment partners, and delivery companies.

18. Service Availability

We may update, maintain, modify, or temporarily suspend parts of the Services. We do not guarantee that the website will always be uninterrupted or error-free.

We are not responsible for interruptions caused by events outside our reasonable control, subject to responsibilities that cannot legally be excluded.

19. Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis. We disclaim implied warranties to the extent they may legally be disclaimed.

This provision does not exclude any express warranty, statutory product guarantee, or consumer right that cannot legally be waived.

20. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot be excluded for fraud, intentional misconduct, gross negligence, personal injury, unsafe or defective products, or violation of mandatory consumer rights.

To the fullest extent permitted by law, Patché Skin will not be liable for indirect, incidental, special, punitive, or consequential loss arising from the Services.

Where permitted by law, Patché Skin’s total liability for a claim relating to an order will not exceed the amount paid for the product or order giving rise to the claim.

These limitations apply only to the extent that they are valid and enforceable under applicable law.

Governing Law and Dispute Resolution

These Terms and any purchases made through Patché Skin are governed by the laws of the Commonwealth of Pennsylvania and applicable federal laws of the United States, without regard to conflict-of-law principles.

Before beginning formal proceedings, you agree to contact us at support@patchéskin.com so that both parties can attempt to resolve the dispute in good faith.

Any dispute that cannot be resolved informally will be handled by a court of competent jurisdiction in Pennsylvania, unless applicable consumer law allows or requires a different venue.

Nothing in these Terms limits any consumer right or remedy that cannot legally be waived.

22. Changes to These Terms

We may update these Terms to reflect changes to our Services, business practices, or legal obligations.

Updated Terms will be posted with a revised “Last updated” date. Material changes will receive additional notice where required by law.

Changes apply prospectively and will not alter an order already accepted unless required by law or agreed with the customer.

23. Severability and Waiver

If any provision of these Terms is held unlawful or unenforceable, it will be modified only to the minimum extent necessary or severed. The remaining provisions will continue in effect.

A failure to enforce a provision does not waive the right to enforce it later.

24. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, Return and Refund Policy, and any order-specific terms displayed at checkout, constitute the agreement between the customer and Patché Skin concerning the Services.

If an order-specific term conflicts with these Terms, the order-specific term controls for that purchase unless applicable law requires otherwise.
